But is a criminal getting off on a technicality really justice?? If justice was served the doper with the coke would go to jail, regardless of whether the cop mirandised him correctly. The reason the drug agency has such a good strike rate is that it is all based on scientific evidence. It doesn't rely on eye witnesses or otherevidence where there is a degree of uncertainty. Yes, the science can be flawed, but that is why they have the 'B' sample. Zero tolerance means just that.

Hi Craig, It's a good question but you can also see, at least in the U.S. since DNA testing has exonerated a lot of prisoners, how police tactics can be abused and that's one of the reasons those laws are in place. The idea that the drug tests are scientifically secure is one of the ideas that took a hit in the Landis case. First of all, it requires humans to carry out the test and the lab did not properly carry out the initial tests. Second, the same tests that the French lab viewed as positive would not necessarily have been viewed as positive in labs in other countries (at least according to evidence introduced by Landis'legal team.) As for the B samples, I believe the synthetic testosterone tests were done on B samples without a test on the A samples because all of the A samples were used up when those samples were tested in earlier stages.
